1. General Provisions
These Terms of Service (the "Terms") govern the use of the website feeling.app ("Feeling.app", created by Rytis and Violeta).
By using the Website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any of these Terms, please do not use the Website.
2. Service Description
Feeling.app (by Rytis and Violeta) is an Artificial Intelligence (AI) powered platform providing:
- Personal AI assistant for emotional support and reflective guidance
- Personalized responses based on user context
- Daily messages and inspirations
- Voice conversation feature (when enabled)
Important Disclaimer
This service is not professional psychological or medical help. Our AI assistant provides general support and inspiration, but cannot replace a licensed psychologist, psychiatrist, or other healthcare professional. If you are experiencing serious mental health issues, please seek professional help.
3. Registration, Free Trial and Account
3.1. Free Trial
When registering for Feeling.app, you receive 3 free answers (3 credits). This allows you to try the service before purchasing. During the free trial:
- You can ask 3 questions to the AI assistant (standard-length answers)
- Some features (Daily Message, Profile, Deep Answer, Voice Mode) are locked and become available only after purchase
- One person may create only one free account — abuse cases (repeat registration, IP/device manipulation) may result in account suspension
3.2. Registration Requirements
- You must be at least 16 years of age
- You must provide a valid and working email address (confirmation required)
- Password must meet security requirements (min. 6 characters)
3.3. Account Security
- You are responsible for maintaining the confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Sharing your account with others is prohibited
3.4. Account Suspension
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You use the service for illegal purposes
- You deliberately attempt to harm the system or other users
4. Credits System and Payments
4.1. Free Trial
Every new user receives 3 free credits upon registration. This allows you to try the service with no financial commitment.
4.2. Purchasing Credits
- Credits are purchased through our partner payment system (ThriveCart) — one-time payments, no subscriptions
- Prices are displayed in EUR and may be changed
- Once purchased, credits are immediately added to your account
- Account and credits are valid indefinitely — no expiration date
4.3. Using Credits
- Standard answer: 1 credit
- Deep answer: 2 credits
- Daily message: 1 credit
4.4. Credit Validity
- Purchased credits are valid indefinitely as long as your account is active
- Upon account deletion, unused credits are forfeited
Note: Credits are a digital product. Their value depends on AI service costs, which may vary.
5. Refund and Cancellation Policy
5.1. Free Trial as Basis for Decision
Before purchasing credits, every user receives 3 free answers to evaluate the quality and suitability of the service. This provides the opportunity to make an informed decision before payment.
5.2. Refund Policy
Refunds are not provided.
Since credits are digital content that is delivered immediately after purchase (credits become available for use right away), and since every user has the opportunity to try the service for free before purchasing, the standard 14-day right of withdrawal does not apply under Lithuanian Civil Code Article 6.22810 and EU consumer rights directives (Directive 2011/83/EU, Article 16(m)).
5.3. Exceptions
Refunds are available only in the following cases:
- Technical error: if credits were not assigned due to our system error
- Double charging: if you were charged twice due to a technical error for the same purchase
In such cases, contact: help@feeling.app within 14 days of purchase, including payment details.
6. Prohibited Actions
By using the Website, you agree not to:
- Use the service for illegal purposes
- Attempt to deceive or manipulate the AI system
- Distribute malware or malicious software
- Attempt to gain unauthorized access to systems
- Impersonate other individuals
- Send spam or automated queries
- Resell or transfer the service to others
7. Intellectual Property
7.1. Our Content
The Website's design, logos, texts, and software are the property of MB VIOLETINIS RYTAS and are protected by copyright laws.
7.2. AI-Generated Content
- AI assistant generated responses are intended for personal use only
- You may save and use responses for your personal needs
- Mass copying and distribution of AI content for commercial purposes is prohibited
7.3. Your Content
Your submitted questions and conversations remain your property. You grant us a limited license to use this data for providing and improving the service.
8. Limitation of Liability
8.1. Service "As Is"
The service is provided "as is" without any warranties, except those expressly stated in these Terms.
8.2. AI Content Liability
Important: AI-generated content may be inaccurate, outdated, or unsuitable for your specific situation. We are not responsible for:
- Decisions made based on AI advice
- Accuracy or completeness of AI content
- Any harm arising from interpretation of AI responses
8.3. Maximum Liability
Our maximum liability in any case shall not exceed the amount you paid for services in the last 12 months.
9. Service Changes
We reserve the right to:
- Change service features and prices with advance notice
- Temporarily suspend the service for technical maintenance
- Discontinue the service with 30 days' notice to users
In case of service discontinuation, unused credits will be proportionally refunded.
10. Applicable Law and Dispute Resolution
10.1. Applicable Law
These Terms are governed by the laws of the Republic of Lithuania.
10.2. Dispute Resolution
- First, we attempt to resolve disputes through negotiations (within 30 days)
- If unsuccessful, disputes are handled in the courts of the Republic of Lithuania according to the Company's registered address
- Consumers in EU countries may use the ODR platform: ec.europa.eu/consumers/odr
11. Changes to Terms
We may modify these Terms. We will notify about significant changes via:
- Email to registered users
- Notice on the website
Continued use of the service after changes indicates acceptance of the new Terms.
